Rhode Island judge Joseph Abbate passed away, remembered for decades of public service

PROVIDENCE, R.I. — The Honorable Joseph Abbate, a longtime Rhode Island administrative magistrate, has passed away at 74.

A Rhode Island native with deep ties to the community, Abbate was a graduate of Providence College, where he earned a bachelor’s degree. He later obtained his law degree from Suffolk University Law School in Massachusetts.

During his time on the bench, Abbate was known for his professionalism, legal knowledge. Friends and colleagues describe him as a dedicated public servant committed to fairness and the rule of law.

Judge Abbate spent 27 years with the City of Providence’s community development office, rising from an entry-level role to Deputy Director and Acting Director. He also served as Executive Director of the Providence Economic Development Corporation and legal counsel for the Providence Plan Housing Corporation. In 2002, he was appointed an Associate Judge of the Providence Housing Court, later serving nine years as an Associate Judge in Providence Municipal Court.

At the state level, Joseph worked as Director of the Law Revision Office for the Rhode Island General Assembly. He was appointed Magistrate of the Rhode Island Traffic Tribunal in 2013 by Chief Justice Paul Suttell and became Administrative Magistrate in 2018. Known for his fairness and integrity, he was widely respected on the bench.

He graduated summa cum laude from Providence College and earned his law degree from Suffolk University Law School while working full time. He was admitted to the Rhode Island Bar and U.S. District Court in 1991.

His private practice covered domestic and juvenile law, personal injury, real estate, and more. He also served as Assistant Town Solicitor in Smithfield and held leadership roles with several legal and community organizations.

As word of his passing spreads, members of the legal community and beyond are reflecting on his legacy of service and his lasting impact on the state’s judiciary.

  • I am deeply saddened and stunned by the passing of our special friend. Our Friday night dining routine was greatly enhanced by the Judge and Mrs. Abate’s (Kathy’s) presence at the “corner table” at the Old Canteen, which had closed last year. Sadly, the week or two before closing was the last time we were in his company. He was a gracious man, Judge and public figure we had the pleasure of getting to know. My heart is broken by this news as I was hopeful to see them again someday soon. Rest in Peace Judge and thank you for the best ricotta pie ever!

    Please accept my sincere condolences of your tragic loss. Judge Abbate was a classy man. This is the only way to sum him up. I had the Honor and pleasure to be able to practice in front of my earliest days at Providence Municipal Court.
    I practiced almost daily in front of him at Ritt. Even if he ruled against you u respected his decision. He will be sorely missed . This man was a great asset not only to his job but also to the legal profession.

  • He was a true gentleman who treated everyone, clients, lawyers, and everyone else involved in the Court system with the utmost respect. He will be greatly missed. My heart aches for Joe and his entire family.

  • Joe and I were colleagues for nearly two decades with the City of Providence. His decency and competency were hallmarks of his tenure. Joe was by nature quiet and humble but was a powerful presence in Providence city government. His judgement, good humor and generosity were attributes that made his friendship special for so many.
